2. השירות
השירות הוא מערכת CRM בענן לעסקים: לידים, לקוחות, משימות, מסרים ואינטגרציות, לרבות Meta Lead Ads, WhatsApp Business Platform, ואינטגרציות נוספות.
3. חשבונות
הלקוח אחראי למשתמשים שלו, לאמצעי הגישה, ולנכונות המידע שמוזן בחשבון.
4. מידע הלקוח
הלקוח הוא הבעלים של המידע שלו. COBWEB מעבדת אותו רק כדי לספק את השירות, לפי מדיניות הפרטיות.
5. אינטגרציות צד שלישי
כאשר לקוח מחבר Facebook, Instagram או WhatsApp, הוא מאשר ל-COBWEB לגשת לנכסים המחוברים רק ככל שנדרש לתכונות שהוא משתמש בהן. השימוש כפוף גם לתנאי ולמדיניות של Meta. אפשר לנתק את החיבור בכל עת מהגדרות ה-CRM.
6. שימוש מותר
אין לשלוח ספאם ואין לשלוח מסרים בלי הסכמת הנמען (opt-in). יש לציית ל-WhatsApp Business Messaging Policy ולדין החל, לרבות חוק התקשורת (בזק ושידורים), התשמ"ב–1982, סעיף 30א. אין להעלות או לשלוח תוכן בלתי חוקי.
7. תשלום
התשלום הוא לפי המסלול או ההסכם, בתוספת מסים ככל שהדין מחייב. אי-תשלום עשוי להשעות את השירות. חיובים של צד שלישי, לרבות חיוב שיחות WhatsApp של Meta, חלים על הלקוח אלא אם הוסכם אחרת.
8. זמינות ושינויים
אנו משקיעים מאמץ סביר להפעיל את השירות. אין התחייבות לזמן פעילות מסוים. תכונות עשויות להשתנות.
9. השעיה וסיום
כל צד רשאי לסיים את השימוש. בסיום אפשר לייצא מידע ולבקש מחיקה בעמוד מחיקת המידע.
10. הסתייגות והגבלת אחריות
השירות ניתן כפי שהוא זמין. האחריות מוגבלת לדמי השירות ששולמו בשלושת החודשים שקדמו לדרישה, אלא אם הדין אינו מאפשר הגבלה זו.
11. שינויים בתנאים
המשך שימוש אחרי תאריך העדכון הוא הסכמה לתנאים המעודכנים. התאריך בראש העמוד הוא הגרסה הנוכחית.
12. דין וסמכות שיפוט
דיני מדינת ישראל. סמכות השיפוט: בתי המשפט של [CITY], ישראל.

2. The service
The service is a SaaS CRM for businesses: leads, customers, tasks, messaging, and integrations, including Meta Lead Ads, the WhatsApp Business Platform, and others.
3. Accounts
The customer is responsible for its users, its credentials, and the accuracy of the data entered in the account.
4. Customer data
The customer owns its data. COBWEB processes it only to provide the service, as described in the Privacy Policy.
5. Third-party integrations
When a customer connects Facebook, Instagram, or WhatsApp, the customer authorizes COBWEB to access the connected assets only as needed for the features they use. Use is also subject to Meta's terms and policies. The customer can disconnect at any time from the CRM settings.
6. Acceptable use
No spam. No messaging without the recipient's consent (opt-in). Comply with the WhatsApp Business Messaging Policy and applicable law, including the Israeli anti-spam law, section 30A of the Communications Law (Telecommunications and Broadcasting), 1982. No unlawful content.
7. Fees and payment
Fees follow the plan or agreement, plus taxes where required. Non-payment may suspend the service. Third-party fees, including Meta WhatsApp conversation charges, are the customer's responsibility unless agreed otherwise.
8. Availability and changes
We make reasonable efforts to keep the service available. Uptime is not guaranteed. Features may change.
9. Suspension and termination
Either party may end the service. On termination the customer may export data and request deletion on the data deletion page.
10. Disclaimer and limitation of liability
The service is provided as available. Liability is limited to the fees paid for the service in the three months before the claim, except where the law does not allow that limit.
11. Changes to these terms
Continued use after the updated date is acceptance of the new terms. The date at the top of this page is the current version.
12. Governing law
The laws of the State of Israel. The courts of [CITY], Israel.
